It's quaint that in the clip everyone seems to agree that the voters will decide and the election will put an end to it but we know that Trump only accepts one result. It's going to be deja vu all over again. It will not stop at the election either way

In light of the new reporting of call made by tfg and Ronna to County Canvassers in MI asking for favors and offering attorneys, I re-read the session from the J6Committee transcript that contained testimony about the calls (and more!) others received, it is really worth reading in fresh context.

Thank you Asha and welcome back! I just put (The Shadow Docket) on my list of books to read in 2024.

Really enjoyed the discussion with Steve Vladek on the pod about the Colorado Supreme Court ruling's prospects at SCOTUS. Just one thing had me shouting at my iPad a bit (which Siri never appreciates): Vladek's blithely repeated assessment that it would be better societally for Trump to be defeated at the polls than kept off the ballot. This is certainly true as a binary choice. But even beyond your point that Trump World wouldn't accept defeat at the polls anyway, no one seemed to acknowledge the even more gaping flaw in this rationale: TRUMP MIGHT WIN!

Happy Holidays and a Happy New Year, Asha! As a paid subscriber to both your’s and Steve Vladeck’s Substack, I truly loved this podcast with you both! So in-depth and nicely presented in layman terms!

Merry Christmas, Asha. Thanks for all the presents you've given us throughout the year with your wit, wisdom and insights. And as my German friends say, wishing you a good slide into the New Year, too.

The article you wrote with Marc sure highlights the risks of allowing one person to handpick whomever they want. Letting someone like Trump do the picking will assuredly lead to many poor and dangerous choices. When Madison wrote in the Federalist Papers about factions I doubt he envisioned anyone like Trump..... nor the existence of such a large and virulent minority.

Are you recommending the flu and Covid shots because you hadn’t received them and feel that you wouldn’t have gotten sick if you had?

No, I got both...I think I would have been much worse if I hadn't gotten them. I have heard of people being sick for weeks...

Yeah, the sickness seems to be going around whether you got the shots or not—feels like a real chicken/egg scenario. I hope I can avoid it.

Anyway,

Merry Christmas, Asha

and Happy New Year

I can relate. Something always goes wrong for me this time of year when it's least convenient. This year it's the water heater failing today as my girlfriend arrives from LA to spend Christmas at my house. In the words of Rosanne Rosannadanna, "It's always something."

STRONGLY DISAGREE: "Let’s not forget that, by all indications, the January 6 Committee is also what (finally) spurred the Justice Department into action, as far as investigating people at the top, rather than just the foot soldiers."

I am deeply grateful to the J6 Committee for their work and the public hearings they conducted. But the J6 committee was not tasked with proving any cases in a court of law beyond a reasonable doubt. DOJ must necessarily do a lot of its work out of the the public eye to carefully construct the most iron-clad cases possible. Marcy Wheeler has done an excellent job of summarizing key steps and various challenges that had to be overcome along the way. This article from April of this year is one such summary with links to previous articles. https://www.emptywheel.net/2023/04/06/the-testimony-jack-smith-gets-this-week-builds-on-work-from-over-a-year-ago/
